HB 250: Impact Fees and Property Rights

Too often important local property rights issues are overlooked as people get caught up in the minutia of the Utah code. Representative Mike Schultz is addressing one of these complex issues via House Bill 250.
Impact fees are often charged to compensate for the additional strain on local infrastructure as new homes and developments are built. Sometimes the individuals and entities who are charged these fees disagree with the amount charged, but have difficulty seeking recourse. HB 250 provides individuals and companies with clearer standing and procedure to challenge those impact fees.
The bill also provides additional funding to the Property Rights Ombudsman to provide education and training on land use laws and regulation, as well as dispute resolution. The Property Rights Ombudsman’s office has played a critical role in defending property rights and handling conflict resolution between property owners and local government jurisdictions. Investing a portion of existing surcharge funds into the office will be a worthwhile decision.
