HB 152: Accessible, Convenient Tele-Healthcare

During Utah’s 2023 General Legislative Session, House Bill 152, sponsored by Representative James Dunnigan, may deregulate telehealth in a vital way. 

This legislation would repeal Title 58, Chapter 83 of the Online Prescribing, Dispensing, and Facilitation Licensing Act and repeal a section of code that restricts providers from diagnosing patients, providing treatment, or prescribing medication based solely on an online questionnaire, email message, or patient-generated medical history. These changes would signify a highly beneficial development for the healthcare industry.

Online platforms for the prescription and distribution of medication have become increasingly popular in recent years, providing a convenient and efficient way for patients to receive the healthcare they need. 

However, the current regulations, could be hindering innovation in the field. The repeal of this legislation would allow for the growth and advancement of the online prescribing and dispensing industry, promoting innovation and increasing the efficiency of healthcare delivery.

In addition to promoting innovation, the repeal of these regulations would also provide greater access to healthcare for those living in rural or underserved areas. Patients in these areas may not have easy access to a doctor or pharmacy in their community, and online platforms provide a viable alternative for receiving necessary medications.

While some may argue that the repeal of these regulations could lead to increased instances of prescription drug abuse and fraud, it is important to note that the repeal of the legislation does not necessarily mean that there will be no safeguards in place to prevent these issues. It will be up to lawmakers to put appropriate measures in place to ensure that online prescribing and dispensing is conducted safely and responsibly.

The passing of this proposed legislation would be a highly positive development for the healthcare industry. It would allow for the growth and advancement of the online prescribing and dispensing industry, increase access to healthcare for those in underserved areas, and provide greater flexibility and convenience in the provision of telehealth services.
