When law enforcement seizes a computer device as evidence, the process for retrieving personal data can be invasive and unclear. Even when a device is not deemed contraband, owners still often face delays or barriers in retrieving their data or device.
Senate Bill 252, sponsored by Senator Todd Weiler, establishes a clear procedure for the return of non-contraband computer devices, ensuring that Law enforcement must copy the data within 72 hours and return the device promptly. Owners aren’t required to unlock the device or provide a password to retrieve it and any copied data remains protected by warrant and evidence rules.
Libertas supports this bill because it protects personal property, promotes transparency in law enforcement practices, and ensures individuals’ rights to privacy remains intact.
