Senate Bill 217 by Sen. Kirk Cullimore modernizes and expands Utah’s legal framework for locally produced food, strengthening economic freedom for small producers while reducing unnecessary regulatory barriers.

The bill clarifies when and how homemade food prosadducts qualify as “homemade food” under Utah’s Home Consumption and Homemade Food Act.

It removes a requirement that certain direct-to-sale farmers markets display specific signage, simplifies when producers and their designated representatives may sell products directly to consumers, and ensures that producers retain ownership of products sold through designated representatives unless otherwise agreed upon. Additionally, the bill exempts direct sales of homemade food products from state sales tax and aligns statute with modern small-farm practices.
